Post-Quantum Encryption Legal Notice

Intellectual Property

All post-quantum encryption algorithms, implementations, and cryptographic tools provided by our application are Fated LLC's intellectual property. Our quantum-resistant cryptographic implementations are copyright-protected (see 17 U.S.C. §101 et seq.), and our trademarks and trade names are registered and owned by Fated LLC. We strictly prohibit any unauthorized use of Fated's marks or branding.

Our post-quantum encryption application at https://fated.org/stuff/PostQuantumEncryption/crypt.php contains proprietary cryptographic implementations that may not be reverse-engineered or redistributed without explicit permission.

False or misleading labels implying sponsorship or origin of cryptographic services are illegal under the Lanham Act (15 U.S.C. §1125). Any unauthorized copying of our cryptographic implementations will be removed promptly under our DMCA policy (below).

DMCA (U.S. Copyright Compliance)

Fated LLC complies with the Digital Millennium Copyright Act (DMCA, 17 U.S.C. §512) by providing a designated agent to receive infringement claims. If you believe your copyright-protected work has been posted without permission, you may submit a takedown notice to our DMCA agent (see "Contact" below).

DMCA notices must meet statutory requirements including identifying the copyrighted work, providing contact information, and a good-faith statement. Upon receipt of a valid notice, we will expeditiously disable or remove the infringing content and notify the user who posted it.

We also honor DMCA counter-notifications under 17 U.S.C. §512(g)(3): if a user files a counter-notice asserting a good-faith belief that the removal was mistaken, we will restore the material within 10–14 business days unless the original complainant obtains a court order against it.

Repeat infringers will have their accounts terminated. Our DMCA agent's contact information and procedures are clearly posted here, so copyright owners and users alike know their rights and obligations.

Privacy & Data Protection

Fated LLC handles personal data with the highest privacy standards. We adhere to the GDPR (Regulation (EU) 2016/679) for EU residents and the equivalent UK GDPR/Data Protection Act 2018 for UK residents (gov.uk).

Consistent with GDPR Article 5, all personal data are processed "lawfully, fairly and in a transparent manner" and only for the specific, explicit purposes disclosed to users (gdpr-info.eu).

We implement data minimization, accuracy checks, and strict security measures ("integrity and confidentiality" of data).

EU and UK visitors have full rights to access, correct, or erase their data; we provide easy-to-use forms for data subject requests.

CCPA (California): California residents may request access, deletion, and non-sale of their personal information under Cal. Civ. Code §1798.100 et seq., to the extent applicable.

COPPA: If children under 13 use our services, we comply with the Children's Online Privacy Protection Act – i.e. we obtain parental consent before collecting personal info from minors (ftc.gov) and provide clear notices of our practices.

Global Laws: We also follow other privacy laws (e.g. Canada's PIPEDA, Australia's Privacy Act 1988). The Australian Privacy Act is "the principal piece of Australian legislation protecting the handling of personal information" (ag.gov.au).

In each region, data subjects have rights (access, correction, portability) under local law, and we commit to cross-border data transfer safeguards (e.g. EU Standard Contractual Clauses) where needed.

All privacy practices – including our use of cookies, third-party trackers, and analytics – are described in the Privacy Policy section, with opt-in or opt-out mechanisms as required by law. For example, EU visitors must consent to non-essential cookies in compliance with the ePrivacy Directive.

Liability and Immunity

Disclaimer of Warranties: Fated LLC provides all cryptographic services and post-quantum encryption tools "AS IS" with no warranties. We do not guarantee that our encryption algorithms are unbreakable or that our application is error-free or available at all times. We disclaim liability for any damage arising from use of our encryption services, to the fullest extent permitted by law.

User Content: Fated LLC is not liable for user-submitted content. As an "interactive computer service" under 47 U.S.C. §230, we will not be treated as the publisher or speaker of information provided by users (law.cornell.edu).

In other words, Fated is generally immune from liability for defamation, harassment, or copyright infringement claims based on user posts. If you post content to our site, you are responsible for it (we only remove content that violates these terms or the law, but legally we are not the author). This immunizes us from third-party liability (consistent with Section 230 of the Communications Act).

Limitation of Liability: We explicitly limit our liability for any cause of action. To the maximum extent allowed, Fated LLC (and its affiliates, directors, employees, and agents) will not be responsible for special, consequential, or punitive damages, or any loss of profits or data, even if advised of the possibility of such damages. Our total liability, if any, is limited to the amount paid by you (if any) for access to our services.

Cookies and e-Privacy

This site uses cookies and similar technologies (e.g. web beacons, local storage) to improve functionality and analytics. We comply with the Privacy and Electronic Communications Regulations (PECR) in the UK and the EU's e-Privacy Directive (ico.org.uk).

  • Consent: We obtain user consent before setting any non-essential cookies (those not strictly needed for basic site operation).
  • Transparency: Our Cookie Policy lists all cookies used (session cookies, analytics cookies, etc.) and their purposes.
  • EU e-Privacy: PECR specifically regulates cookies and electronic marketing; we follow both PECR and GDPR guidance. For example, if cookie data can identify a person, it is treated as personal data (subject to GDPR/UK GDPR).

Users can manage cookie preferences via the banner or their browser settings. Note that disabling cookies may affect site functionality but will not prevent access to any content.

AI-Generated Content & User Rights

Fated LLC may use AI tools (e.g. text generators or image tools) for internal content development. All AI-generated content on this site is created under our supervision and is owned by Fated LLC.

To the extent allowed by law, Fated LLC retains all rights to AI-generated text, code, or images, and no user may claim ownership of such content. Users remain responsible for any content they submit (e.g. text, images, feedback).

We encourage responsible AI use: any apparent errors in AI-produced material should be reported to us for correction.

Cryptographic Export Controls: Our post-quantum encryption technology may be subject to U.S. export controls (EAR and ITAR). Fated LLC complies with the U.S. Export Administration Regulations (EAR) enforced by the BIS. Under the EAR §734.1, cryptographic items subject to the EAR are defined and may require licensing (bis.gov). Our post-quantum cryptographic implementations may fall under encryption export restrictions.

The Arms Export Control Act (22 U.S.C. §2778) empowers the U.S. President to control exports of defense articles (uscode.house.gov). We do not knowingly export any restricted cryptographic technology without proper authorization. Users are responsible for compliance with their local import/export laws when using our encryption services.

Accessibility

Fated LLC is committed to making this site accessible to all users. We follow WCAG 2.1 AA standards: the site is built with semantic HTML, alt text on images, ARIA labels, sufficient color contrast, keyboard navigation support, and captions/transcripts for media.

WCAG 2.1 is the international guideline for web accessibility (w3.org), and it ensures content is perceivable, operable, understandable, and robust.

We conduct regular audits against WCAG 2.1 success criteria to meet at least AA compliance. This also reflects U.S. law: the Americans with Disabilities Act (ADA) mandates non-discrimination in public accommodations. The ADA is "a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities" (law.cornell.edu).

Following ADA guidance and WCAG, we strive to make every user's experience accessible – for example, providing text alternatives and avoiding flashing content. If you encounter any accessibility issue, please contact our support so we can remedy it promptly.

Export and International Compliance

We operate globally and comply with all relevant laws. Besides U.S. EAR/ITAR noted above, we abide by foreign export laws (for example, we do not engage in transactions prohibited by EU, UN, or other sanctions).

Privacy and consumer protections in each jurisdiction are observed: e.g. GDPR/UK GDPR for EU/UK users (gov.uk, gdpr-info.eu), PIPEDA in Canada (which protects personal information in commercial activities laws-lois.justice.gc.ca), and the Australia Privacy Act (ag.gov.au).

Governing law for disputes is stated in our Terms of Use (typically the state where Fated LLC is registered). However, to the extent any conflict arises, we will honor mandatory consumer protections in the user's country.

Terms of Use

By accessing Fated LLC's website or services, you agree to our Terms of Use. These terms set out your rights and responsibilities: for example, you must be at least 13 years old or have parental consent (per COPPA); you must not use our services for illegal purposes; and you agree not to misuse our content or technology.

We reserve the right to suspend or terminate any user who violates the Terms. Any content you submit (comments, uploads, feedback) is deemed non-confidential and grants us a perpetual license to use it.
