All post-quantum encryption algorithms, cryptographic implementations, and related software provided through our application at https://fated.org/stuff/PostQuantumEncryption/crypt.php are proprietary to Fated LLC.

Copyright Protection: Our software is protected under 17 U.S.C. §101 et seq. Unauthorized reproduction, distribution, or modification of our cryptographic implementations is prohibited.

Trade Secrets: Our cryptographic optimization techniques, algorithm implementations, and security measures constitute trade secrets under applicable law.

Trademark: "Fated LLC" and associated marks are registered trademarks. Unauthorized use violates 15 U.S.C. §1125 (Lanham Act).

Acceptance: By accessing our encryption services, you agree to these terms and conditions.

Permitted Use: Our services are provided for legitimate cryptographic purposes only. Prohibited uses include:

• Illegal activities or circumventing security measures
• Reverse engineering our cryptographic implementations
• Automated access that exceeds reasonable usage limits
• Attempting to compromise system security or other users' data

User Responsibilities: Users must comply with all applicable laws, including export control regulations when using our encryption technology.

Age Requirements: Services are available to users 16 years or older, or with parental consent per COPPA requirements.

Operational Data:

• IP addresses and geographic location (country-level)
• Cryptographic operation metadata (algorithm type, key sizes, processing times)
• Session identifiers for operational continuity
• User agent strings for compatibility
• Performance metrics and error logs

Security Monitoring:

• Security events and threat detection data
• Access patterns and rate limiting data
• System integrity monitoring logs

Data We Do NOT Process:

• Your encrypted data content
• Your private encryption keys
• Personal identifying information beyond IP addresses

Retention: Operational data retained for 90 days maximum, with automated cleanup procedures.

Disclaimer of Warranties: Services provided "AS IS" without warranties of any kind. We do not guarantee unbreakable encryption or continuous availability.

Limitation of Liability: Fated LLC's liability is limited to the maximum extent permitted by law. We are not liable for:

• Consequential, incidental, or special damages
• Loss of data, profits, or business interruption
• Third-party security breaches or attacks
• User misuse of cryptographic tools

Indemnification: Users agree to indemnify Fated LLC against claims arising from their use of our services.

Section 230 Protection: As an interactive computer service under 47 U.S.C. §230, we are not liable for user-generated content.

U.S. Export Regulations: Our cryptographic technology may be subject to Export Administration Regulations (EAR) enforced by the Bureau of Industry and Security.

International Compliance: Users are responsible for compliance with local import/export laws when using our encryption services.

Sanctioned Territories: Services may be restricted in territories subject to U.S. sanctions or export controls.

Encryption Classification: Our post-quantum implementations may fall under controlled cryptographic categories requiring authorization for export.

Security Measures: We implement industry-standard security controls including:

• TLS 1.3 encryption for all communications
• Multi-factor authentication for administrative access
• Regular security audits and penetration testing
• Automated threat detection and response systems

Incident Reporting: Security incidents are documented and investigated according to established procedures.

Vulnerability Disclosure: We maintain a responsible disclosure policy for security vulnerabilities.

DMCA Compliance: We comply with the Digital Millennium Copyright Act (17 U.S.C. §512).

Takedown Procedure: Copyright holders may submit DMCA notices to our designated agent. Valid notices must include:

• Identification of copyrighted work
• Location of infringing material
• Contact information and good faith statement
• Statement under penalty of perjury

Counter-Notifications: Users may file counter-notices under 17 U.S.C. §512(g)(3) if they believe removal was erroneous.

Repeat Infringers: Accounts of repeat infringers will be terminated according to our policy.

Governing Law: These terms are governed by the laws of the United States and the state of incorporation of Fated LLC.

Jurisdiction: Disputes shall be resolved in courts having jurisdiction over Fated LLC's principal place of business.

Arbitration: Certain disputes may be subject to binding arbitration as specified in our terms.

Class Action Waiver: Users waive rights to participate in class action lawsuits except where prohibited by law.
